If you do not agree to these Terms, you must not access or use the Website or Services.

2. Description of Services – IMPORTANT LIMITATIONS

Monovital provides an online platform connecting users (“You,” “User”) seeking second medical opinions with qualified, independent medical professionals (“Experts”) based on medical reports, images, test results, and descriptions of symptoms provided by the User. Additionally, Monovital offers optional Treatment Planning Services to assist users who have decided on a course of treatment following a second opinion.

KEY SERVICE LIMITATIONS – MONOVITAL DOES NOT PROVIDE:

• Primary Medical Diagnosis or Treatment: The Services are intended to provide a second opinion based on information you provide. They are NOT a substitute for a primary diagnosis, direct medical care, or treatment from your regular healthcare provider.
• Emergency Medical Services: Our Services are NOT for medical emergencies. If you are experiencing a medical emergency, call your local emergency number immediately or go to the nearest emergency room.
• Prescriptions: Experts providing opinions through Monovital do not issue prescriptions.
• Direct Doctor-Patient Relationship (in the traditional sense): While you interact with Experts, the Service facilitates a consultation based on submitted records. It does not establish a traditional, ongoing doctor-patient relationship for primary care purposes. You should maintain a relationship with a primary care physician or other qualified healthcare provider.

Specific Services Offered:

• Second Medical Opinion Service: Users can submit their medical reports, images, test results, and symptom descriptions. Designated Experts review this information and provide a written second medical opinion report. Reports are typically provided in the User’s selected language where available.
• Treatment Planning Service: For users who opt for this service after receiving an opinion, Monovital assists in coordinating aspects of their chosen treatment, which may include providing information on potential doctors and institutions, assisting with appointment scheduling inquiries, and providing guidance on potential costs and logistics based on publicly available or partner-provided information. Monovital does not make treatment decisions for the user or guarantee specific outcomes.

3. User Eligibility and Responsibilities

• Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
• Accurate Information: You are solely responsible for providing accurate, complete, and up-to-date medical information, including reports, images, test results, and descriptions of your condition and history. The quality and accuracy of the second opinion depend heavily on the information you provide. Monovital and the Experts are not responsible for inaccuracies or omissions in the information you submit.
• Report Uploads: You represent and warrant that you have the legal right to possess and share the medical information you upload for the purpose of obtaining the Services.
• Decision Making: You are solely responsible for any decisions you make regarding your health, diagnosis, or treatment based on the information or opinions received through the Services. The second opinion is informational and should be discussed with your primary healthcare provider before making any medical decisions.
• Compliance: You agree to use the Services in compliance with all applicable local, state, national, and international laws and regulations.

4. User Accounts

Users are responsible for ensuring the security of the accounts they create and their login information. Usernames and passwords are stored on the platform according to web standards. We provide the necessary software options for users to delete the files, images, and documents they have uploaded after receiving their second opinion.

5. Fees, Payment, and Refunds

• Fees: Certain Services, such as obtaining a second opinion or using the Treatment Planning Service, require payment of fees as described on our Pricing page https://monovital.com/pricing. Unless otherwise specified, all fees are stated in US Dollars and are due at the time of service request.
• Payment: We use third-party payment processors (e.g., WooCommerce Payments, Stripe, PayPal) to handle payments. Your payment information is processed directly by these providers according to their terms and privacy policies. We do not store your full credit card information.
• Refunds: Due to the nature of the service and the resources involved in obtaining an expert opinion, fees paid for the Second Medical Opinion Service are generally non-refundable once an Expert has begun reviewing your case. For Treatment Planning, refunds are possible within the first 24 hours following the payment date (before planning work has commenced).

6. Intellectual Property

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Monovital, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may use the Website only for purposes permitted by these Terms.

7. Disclaimers of Warranties

THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MONOVITAL NOR ANY PERSON ASSOCIATED WITH MONOVITAL MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE WEBSITE OR SERVICES.

WITHOUT LIMITING THE FOREGOING, NEITHER MONOVITAL NOR ANYONE ASSOCIATED WITH MONOVITAL REPRESENTS OR WARRANTS THAT THE WEBSITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

MONOVITAL HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

8. Limitation on Liability

IN NO EVENT SHALL MONOVITAL’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR PARTICIPATING IN ANY ACTIVITY RELATED TO THE SITE OR SERVICES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Monovital, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Service’s content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Website or Services.

Cluj without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the federal courts of ROMANIA or the courts of Jud. Cluj located in Jud. Cluj Romania. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
